Obiettivi formativi:
Educational goals:		 L?obiettivo del corso č valutare quale impatto gli scambi interculturali tra societā diverse, che si incrociano per la storia coloniale, per le relazioni internazionali contemporanee, per i flussi di notizie assicurati dai mass media o per i conflitti armati, hanno sugli apparati giuridici costituzionali dei paesi dell?Asia Orientale e del Medio Oriente. Lo scenario e il linguaggio di questi incroci/scambi č il diritto internazionale, i temi sono la democrazia e i diritti umani.
The objective of the course is to evaluate what impact intercultural exchanges between different societies - which have come into contact with each other as a result of colonial history, contemporary international relations, the flow of news through the mass media, or armed conflict - have had on the constitutional laws of East Asian and Middle Eastern countries. International law provides the context and language for each of these crossovers / exchanges, while democracy and human rights constitute the themes.
Contenuto del corso:
Course contents:		 Il corso prende in esame il tema della democrazia e delle strutture istituzionali e le forme giuridiche tese a realizzarla nei contesti ?altri? dall?Occidente, quali Asia Orientale e Medio Oriente. Nello specifico si propone di analizzare i contenuti peculiari che il termine ?democrazia? assume al di fuori del contesto culturale in cui č stato concettualizzato e gli scambi di tipo interculturale che sulla base di tale trasferimento, rielaborazione e retroazione si verificano tra Occidente e Cina (regime autoritario in cui le concessioni all?economia capitalista convivono con la negazione dei diritti umani in Tibet e alla negazione della libertā religiosa) per il quadrante dell?Asia Orientale, e i paesi del mondo arabo e islamico per quanto riguarda il Medio Oriente con particolare riguardo ai temi della relazione tra democrazia e ?ura, diritti umani nell?Islam e diritto internazionale islamico e le minoranze nel mondo arabo. L?analisi sul tema della democrazia e delle sue strutture verrā condotta focalizzando l?attenzione sui diritti umani e la questione delle minoranze etniche, che nello scenario istituzionale disegnato dal diritto internazionale alimentano flussi di interazione interculturale tra l?Occidente e la pluralitā dei contesti ?altri?. Secondo i loro interessi gli studenti potranno decidere di approfondire il tema in base a uno dei due quadranti culturali presi in considerazione.
The course examines the theme of democracy, and of the institutional structures and legal forms designed to realise it in contexts thought of as "others" in the West - East Asia and the Middle East. More specifically, the course proposes to analyse the specific content which the term "democracy" assumes outside the context in which it was formulated and the intercultural exchanges which - on the basis of such translation, re-elaboration and retroaction - occur between the West and China (an authoritarian regime in which the conception of the capitalist economy coiexists with the negation of human rights in Tibet and of religious liberty) across the whole of East Asia and the countries of the Arab and Islamic world with particular reference to the themes of the relationship between democracy and human rights in Isam and international Islamic law and the minorities of the Arab world. The analysis of the theme of democracy and of its structures will be conducted by focussing attention on human rights and the question of ethnic minorities, which within the institutional setting of international law aid the flows of intercultural interaction between the West and a plurality of "other" contexts. Accordig to their interests, students may decide to develop a particular theme on the basis of one of the two cultural areas taken into consideration.
